EXECUTIVE SUMMARY

1      This is a report for an application for a new off-licence.  The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.

2      No public objections have been received.  However, the reporting agencies have opposed this application and they are supported by the Licensing Inspector.

APPLICANT AND APPLICATION

Applicant

3      The Applicant is a registered company with a sole director and shareholder.

4      The premises was formally a telecommunications retailer that has been refitted to suit the requirements of a bottle store.  The application is accompanied by Building Compliance Certificate.

5      The location is in the Central Activity Zone which allows the sale of alcohol as a permitted activity.

6      The Applicant has indicated the store will be mainly a ‘premium’ wine store.  They state they will not have budget products at the store and will not sell RTDs, beer or shots in single serves.  They believe this would likely discourage younger people from coming to the store.

7      The director/shareholder will be personally managing the premises.  He has previously held a manager’s certificate and worked in a premises for a short time before the Christchurch earthquakes.

PUBLIC NOTICE

8      The public notice first appeared in the Otago Daily Times on 18 January 2017.

Objections

9      There have been no objections lodged with Dunedin City Council within the objection period.

10    However, the Police and Medical officer of Health have opposed the grant of this licence and their position is supported by the Licensing Inspector.

11    Police Objection:  The opposition relates to section 105(i), which refers to the ‘amenity and good order’ of the location not being further reduced but it would be undesirable for another premises to be opened in the area.  the Police also had initial concerns relating to staff training at the premises but this has since been withdrawn.  The reasons for believing it would be undesirable to open another premises are:

·           The number of alcohol related incidents in the area of the proposed premises

·           George Street is a main thoroughfare for students walking to the central part of the city.

12    Medical Officer of Health Objection: Like the Police, the Medical Officer of Health had concerns regarding the staffing and training of the staff and similarly, this has been withdrawn.  The other grounds for opposition include:

·           Greater access to alcohol in the central city is not in keeping with the object of the Act

·           Research has shown there is a risk of increasing levels of crime as licensed premises density increases.

·           There are 12 off-licences within a 1km radius of the Applicant’s address.  While the amenity and good order of the area is unlikely to be further reduced by the grant of this licence it would still be undesirable for another premises to open.

13    The Licensing Inspector supports the position of the other two agencies.

CONCLUSION AND CONDITIONS

Conclusion

14    The District Licensing Committee has been asked to consider the desirability of allowing another off-licence to be opened in the central city.  The applicant has indicated they would not be selling budget alcohol not will they sell single units of alcohol which they believe will discourage the younger people.

15    The Police and Medical Officer of Health have accepted it is unlikely the ‘amenity and good order’ of the area will further reduced but still believe it is undesirable to allow another premises to open.  They believe it would be contrary to the object of the Act.
