EXECUTIVE SUMMARY
1 This is a report for an application for a renewal of an on-licence for the premises situated at 26 The Octagon, Dunedin, and known as the “Dunedin Social Club”, formally called “Alibi”. The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant does not seek any changes to the licence.
3 There have been no public objections received but the three reporting agencies have submitted adverse reports.
APPLICANT AND APPLICATION

4 The premises has been licensed since 2007 when it opened with the name “Alibi”. The name was recently changed to the “Dunedin Social Club”.
5 The application is for a rollover of the current conditions which are:
Monday to Sunday 8.00 am to 4.00 am the following day with the exception of Good Friday, Easter Sunday, Christmas Day and before 1.00 pm on Anzac Day when they can only sell alcohol to people dining at the premises.

6 Public notice of their intention to renew the licence did not attract any objections.
7 The reporting agencies, however, all submitted adverse reports.
Police
8 The Police have advised there are currently two enforcement applications before the Alcohol Regulatory and Licensing Authority but in the interests of expediency, have not asked for this renewal to be dealt with at the same time. Their grounds for opposition are:
· Inappropriate promotion of alcohol – promoting cheap alcohol
· Unauthorised sale of alcohol – sale of alcohol during the recent test weekend when there was no special licence
· Object of the Act – the Police do not believe the applicant is complying with this
· The layout of the premises – the outside area is not licensed but the applicant allows people to consume alcohol in the area
· They do not have appropriate systems or training to comply with the Act – security staff are checking identification but not the levels of intoxication.
Medical Officer of Health
9 The Medical Officer of Health (MOH) has raised the following issues:
· They do not believe the applicant has sufficiently trained or experienced duty manager’s to deal with the prevention of intoxicated people gaining entry, preventing people from becoming intoxicated, the removal of alcohol from the premises and the capacity limits of the premises.
· The use of the outside area as part of their premises when it is not licensed.
· The consideration of a 3.00 am one way door as a condition on the licence.
Licensing Inspector
10 The Licensing Inspector supports the position of both the Police and MOH in their opposition. The Inspector has recommended that, if the licence is renewed, that the outside area is licensed in line with other premises in the Octagon and that a one way door becomes a requirement from 3.00 am.
Fire and Emergency New Zealand
11 Fire and Emergency New Zealand initially reported there were issues with fire egress routes being obstructed. An investigation revealed the manager of the premises was not aware of the requirement for multiple exits from the premises and was using the Princes Street entrance as a place to store tables. This matter has been resolved with an undertaking that a new locking system is installed and, in the interim, a member of the security team would be positioned near the door to control its use.
CONCLUSION AND CONDITIONS
12 The premises has had issues in the past with attracting and retaining experienced duty managers which was highlighted in March 2017 when the Police and Licensing Inspector opposed the appointment of two temporary managers.
13 While this matter was resolved at the time the MOH has indicated the premises does not have experienced duty managers working at the busier times and this is leading to control issues.
14 The Police have made application to the Authority for the suspension or cancellation of the licence after breaches of the Act were identified – these are highlighted in the first two points made by the Police above. Because the renewal of the licence is being considered by the Committee it would be prudent for the decision to be made before the Authority considers the enforcement applications.
15 There is a move to licence the areas outside premises in Dunedin to legitimise past convention therefore it would be appropriate for this premises to have their licensed area expanded to include the area outside.
16 Similarly the late night venues are having one way door policies imposed as a condition of licence. Again, this would be appropriate for this premises.
