EXECUTIVE SUMMARY
1 This is a report for an application for the renewal of a club licence by the Mosgiel District Motorcycle Club Incorporated. The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant does not seek any changes to the licence.
3 There were no public objections received after public notice of the application.
4 However, the Licensing Inspector is concerned that the club does not know who they can and cannot sell alcohol to and has therefore opposed the application. The other reporting agencies have not raised any issues.

5 The applicant is an incorporated society registered in 1973. They have been at the current location since 1983.
6 The current licensed hours are:
Tuesday 5.30 pm to 10.00 pm
Wednesday 5.30 pm to 12.00 midnight
Friday 5.30 pm to 1.00 am the following day
Saturday 4.00 pm to 1.00 am the following day
Sunday 4.00 pm to 10.00 pm
PUBLIC NOTICE
7 The Notice of the renewal did not attract any objections from the public.
8 The Police, Medical Officer of Health and Fire and Emergency New Zealand have not raised any matter of concern.
Objections
9 The Licensing Inspector, as part of his inquiries into the application, looked at the club’s financial returns and noted that over 10% of the income from the bar came from another organisation.
10 When the club’s representative was questioned about this the Inspector became aware that the club did not appear to understand the restrictions on club alcohol sales imposed by section 60 of the Act. The representative also did not appear to understand when a special licence was required.
11 The Inspector offered to speak to the club committee about this section but the offer was declined.
12 The Inspector has opposed the renewal so the club can explain to the Committee how they propose to operate within the constraints of section 60 of the Act.
CONCLUSION AND CONDITIONS
Conclusion
13 The Sale and Supply of Alcohol Act 2012 is very prescriptive with regards to who a licensed club can sell and supply alcohol to in their premises. The Inspector is concerned that the club committee is not aware of the restrictions.
14 This hearing will be an opportunity for the club to convince the Committee that they are aware of the legislative requirements associated with being the holder of an alcohol licence.
