EXECUTIVE SUMMARY
1 This is a report for an application for a new off-licence for the premises situated at 2 Mellor Street, Dunedin, and known as “Cableways Liquorland”. The criteria found at section 105 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 This is a new application after the Applicant bought the premises from the previous owner. The hours sought are the slightly different to the temporary authority on which they have been operating.
3 Public notice of the application did not attract public objections.
4 Neither the Medical Officer of Health nor Licensing Inspector opposed the application.
5 The Police have opposed the issue of the licence. They are seeking the imposition of two additional conditions on the licence: no single unit sales of beer, cider or RTDs at or less than $6.00 per unit, and no external advertising or promotion of alcohol.

6 The Applicant has taken over the business and is currently operating pursuant to a temporary authority based on the previous licence. They are seeking the following hours:
Sunday to Tuesday 10.00 am to 9.00 pm
Wednesday and Thursday 10.00 am to 10.00 pm
Friday and Saturday 9.00 am to 10.00 pm
7 The Applicant has other licensed premises outside Dunedin. However, the sole director and shareholder owns the licensee company of “The Rope & Twine” in South Dunedin.

8 Public notice of the application did not attract any public objection.
9 Neither the Medical Officer of Health nor Licensing Inspector opposed the application.
10 However, the Police have opposed the grant of the licence. Their grounds are:
a) S.105(1)(a) – Object of the Act: The sale of single serve, high strength alcohol at a cheap price and the external advertising and promotion of alcohol does not align with the object of the Act.
b) S.105(1)(b) – Suitability: The sale of single serve, high strength alcohol at a cheap price and the external advertising and promotion of alcohol adversely affects the suitability of the Applicant.
c) S.105(1)(h) – Amenity and good order: Police are frequently called to the area within an 800m radius of the premises for incidents including violence and traffic offending.
d) S.105(1)(i) – Amenity and good order already badly affected: no further commentary supplied.
11 To mitigate the issues, the Police seek the inclusion of two addition conditions on the licence:
a) No single sale of beer, cider or RTDs priced at, or less than, $6.00 per unit.
b) No alcohol advertising or promotion on the exterior of the premises.
CONCLUSION AND CONDITIONS
12 The Applicant is new to Dunedin but has premises outside of Dunedin. No adverse comments about the operation of his other premises have been received.
13 The Police are seeking the inclusion of two conditions to mitigate their concerns.
14 The hearing is an opportunity for the parties to present their points of view.
