EXECUTIVE SUMMARY

1          This is a report for an application for a renewal of an on-licence.  The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.

2          The applicant does not seek any changes to the licence.  

3          Public notice of the application attracted one public objection.  Neither the Police nor Medical Officer of Health Delegate have opposed this application.

4          The inspector, however, opposes this renewal application.

APPLICANT AND APPLICATION

Applicant

5          The Applicant company has equal directors and shareholders, Karandeep Singh and Jasleen Saluja.  They both reside in the Dunedin.

6          This is the first renewal of the licence.

7          In the first year of holding the licence, the Applicant has appeared before the Committee when Fire and Emergency NZ applied for the suspension of their licence because the fire escapes were found to be locked when the premises was open for trade.  The matter was resolved before the hearing to the satisfaction of FENZ so the matter could not be taken further.

 

8          In September 2025, the Police issued a Graduated Response Model (GRM) warning after they found intoxicated and abusive people attending a 21st birthday party in the upstairs restaurant.  Staff did not appear to be cognisant of the state pf the patrons. 

PUBLIC NOTICE

9          Public Notice of the application attracted one objection.  The objection related to the suitability of the Applicant claiming they were being ‘victimised’ by the Applicant because they were suspected of advising FENZ of the locked fire egress routes.

10        The Police did not oppose the application but noted the GRM warning.  They commented that the Applicant was pro-active in developing an action plan to ensure this behaviour was not an issue in the future.  Since the plan had been developed, there had been no further issues at the premises.

11        The Medical Officer of Health Delegate did not oppose the application.  However, they did recommend a truncated renewal period of 18 months to allow an early review of the Applicant’s progress and continued suitability to hold a licence.  It was noted that the Applicant remained engaged with the GRM process after the September incident.

12        The Chief Licensing Inspector has opposed the licence renewal.  They referred to the hearing relating to the locked fire exits and the incident that led to the GRM warning.  The Inspector said after a monitoring visit of the premises, there were concerns at the state of the premises itself, as well as the intoxication at the party.  The Inspector noted that the Applicant is attempting to address the issues but recommends a 12-18 month truncated renewal to allow the Applicant time to demonstrate their commitment to upholding the requirements in the Act.

CONCLUSION AND CONDITIONS

13        This is an application for the first renewal of an on-licence. 

14        During the first year of trade FENZ made an application for the suspension of the licence because they found the fire exits locked when the premises was trading.  Later in the year the Police issued a GRM warning after intoxicated people were found on the premises.  The Applicant now has an action plan to ensure there is no repeat of the issues identified.

15        One public objection was received questioning the suitability of the Applicant.  They claim they have been victimised because the Applicant thought they contacted FENZ about the fire escapes.

16        Neither the Police nor Medical Officer of Health Delegate opposed the renewal but it is recommended by the MoH Delegate that there should be a truncated renewal period.

17        The Chief Licensing Inspector has opposed the renewal.  They question the suitability of the Applicant because of the issues that have been identified in the first year of operation.,  They recommend that, if the licence is to be renewed, there is a truncated renewal period.

18        The hearing is an opportunity for all parties to present their points of view.
