EXECUTIVE SUMMARY
1 This is a report for an application for a new on-licence for the premises situated at 155 Frederick Street, Dunedin, and known as the “Starters Bar”. The criteria found at section 105 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant is seeking to trade Sunday to Wednesday 12 midday to 12 midnight and Thursday to Saturday 12 midday to 1am the following day.
3 After public notification of the application one public objection was duly made. Both the Police and Medical Officer of Health have opposed the application because the hours are beyond those allowed for a premises in or adjacent to a residential area. There is a decision pending regarding the status of the premises’ location.
APPLICANT AND APPLICATION
4 The applicant, the Otago University Students’ Association Incorporated (OUSA) is the main representative body for the students.
5 They have been looking for a large capacity venue for student orientated functions where they can provide a safe and welcoming place for their customers. Somewhere they can feel at home.
6 Their intention is to try and keep the students in the North Dunedin area rather than have them wander into the Octagon area late at night. The OUSA has harm reduction initiatives they hope will be the start of a culture shift away from the binge-drinking behaviours prevalent amongst younger people.
7 The hours sought are:
i) Sunday to Wednesday 12.00 midday to 12.00 midnight
ii) Thursday to Saturday 12.00 midday to 1.00 am the following day.
8 They have also asked that the premises is designated a supervised area at all times.

9 The Public Notice attracted one objection.
Objections
10 An objection has been received from the landlord’s representative of two properties adjacent to that of the Starters Bar, Ms K Seque. Her parents own the properties at 6 Clyde Street and 153 Frederick Street, Dunedin.
11 The objection is based on the amenity and good order of the location. She said it has been common for people to jump the low boundary fences of both properties and using the driveways as a means to go to and from the premises. The residents of the two properties report finding vomit and urine and occasionally broken glass.
12 Ms Seque does not believe the outdoors area of the premises is a safe place. The licensee does not have security in the area and this is allowing underage patrons to enter the property.
13 This has been a problem for many years and does not believe the new owners will solve the problems.
Agencies
14 The Medical Officer of Health (MOH) initially opposed the application because they considered the amenity and good order of the location was affected by the presence of the premises. After a monitoring visit the MOH also doubted the applicant had the staff, systems and training to be compliant with the legislation.
15 Both the MOH and Police have opposed the application because the trading hours sought exceed those allowed for a premises in or adjacent to a residential area. A hearing was held on 12 March 2019 to consider whether the premises is deemed to be in or adjacent to a residential area. the decision for this is pending.
16 The OUSA has implemented a management plan to address the issues identified during the monitoring visit. A further visit was made which has satisfied the MOH that the new operators are taking their responsibilities seriously.
CONCLUSION
17 There are two matters for the Committee to consider. The first is the relationship with the neighbouring properties and how it can be managed. The second relates to the trading hours which in turn is dependent on the findings of the Committee regarding the premises location and whether it is deemed to be in or adjacent to a residential area.
18 The decision regarding the premises location is not available at the time of writing this report.
