EXECUTIVE SUMMARY
1 This is a report for an application for a special licence. The criteria found at section 142 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant is seeking a special licence for both New Year’s Eve and Good Friday 2020 when the Highlanders are playing a Super 15 rugby game at the Forsyth Barr Stadium.
3 The New Year’s Eve part of the application is not opposed but the reporting agencies, Police, Medical officer of Health and Licensing Inspector oppose the Good Friday.
4 Premises cannot be open on Good Friday unless those patrons are there for the purposes of dining or there is a special licence in place for an event at the premises.

5 The applicant has owned the premises since 2002. In that time there have been no issues regarding their suitability.
6 The New Year’s Eve part of the application is for an extension of trading to allow patrons to celebrate the arrival of the new year. This is not opposed by the agencies.
7 The second part of the application is for Good Friday, 10 April 2020 between 4pm and 10.30pm. The event is described as a Highlanders versus Sharks rugby game.
8 The premises is to be designated a supervised area on both occasions.
9 More detail for the night was requested of the applicant. They are:
· The hours of the special licence would be 4.30pm to 6.45pm and then again 9.30pm to 11pm.
· The 30 season ticket holders who go to every Highlanders game would have a barbeque and a drink before being bused to the stadium for the game.
· After the game they would be taken back to the tavern for a drink while safe transport options were arranged.
· The premises would not be open while the game was being played and facilities like the gambling machines would not be available.

10 The application was not publicly advertised.
Objections
11 Police: The grounds for Police opposition are:
· There is no actual event on the application
· Details of the game to be played differ to that in the application – the application has the game being played against the Sharks when in fact it is the Chiefs.
· Police believe the application is an attempt to trade on one of the sacrosanct days when the premises is required to be closed.
12 Medical officer of Health: The opposition supports the position of the Police and makes the comment that the event is the Highlanders game and the location of the event is the Forsyth Barr Stadium, not the tavern.
13 Licensing Inspector: The Inspector supports the position of the two other agencies.
CONCLUSION AND CONDITIONS
14 The legislation requires all on-licensed and club premises to be closed on Good Friday unless the people are present for the purposes of dining or there is a special licence in place to allow the sale and supply of alcohol at an event at the premises.
15 An ‘event’ is defined as including an occasion and a gathering. However, while there is no further explanation, a special licence cannot be granted to allow trading when the premises should otherwise be closed.
16 It is for the Committee to determine whether or not the proposal by the applicant is deemed to be a function for the purposes of the Act.
