Temporary Road Closure - Vogel Street

EXECUTIVE SUMMARY
1 There has been a request to use an area of Vogel Street for the purpose of film-making.
2 This report recommends a Council resolution to temporarily close the road concerned using the provisions of the Local Government Act 1974, to enable the film-making as requested to proceed.
That the Council: a) Decides pursuant to Section 319, Section 342, and Schedule 10 of the Local Government Act 1974, to close the portions of Vogel Street as detailed below; i) Friday 19 March from 3.45pm to 2.30am the following day, from 22 Vogel St to Jetty St. ii) Saturday 20 March, from 3.45pm to 2.30am the following day, from 22 Vogel St to 115 Vogel St. iii) Sunday 21 March, from 3.45pm to 2.30am the following day, from 22 Vogel St to 115 Vogel St. iv) Tuesday 23 March, from 4pm to 2.45am the following day, from 22 Vogel St to Jetty St. v) Wednesday 24 March, from 7:30pm to 6.15am the following day, from Queens Garden to Jetty St. |
BACKGROUND
3 There has been a request from a film productions company to use a portion of Vogel Street for the purpose of film-making.
4 A plan showing the area that the film company is wanting to use is attached.
DISCUSSION
5 The area proposed to be used for film-making is legal road, and can therefore be temporarily stopped, if the statutory temporary road stopping procedures are followed.
6 There is a clearly defined process for closing roads in the Local Government Act 1974 ("LGA 1974"). Where the proposed temporary road stopping relates to film-making the decision to close a road cannot be delegated to Council staff; a resolution of Council is required.
7 Section 319 of the LGA 1974 gives Council the power to stop or close any road or part of a road in the manner and upon the conditions set out in section 342 and Schedule 10 of the LGA 1974.
8 Under clause 11(e) of Schedule 10 of the LGA 1974, Council can temporarily close a road for the purpose of film-making if certain conditions are met, as detailed in this report. A copy of Schedule 10 of the LGA 1974 is attached as Attachment C.
9 There is a requirement for Council to assess effects on traffic. With the appropriate traffic management plan, traffic will not be impeded unreasonably as there is an adjacent detour available very near the closed portion of road. The temporary traffic management plan process will ensure that other issues are addressed.
10 Through the temporary traffic management plan process:
a) The film-makers are required to consult affected persons in order that access provisions will be managed.
b) A condition will be included specifying that the cost of repairing any damage caused by the film-makers will be met by the film-makers.
11 Council is required to give public notice of a proposed temporary road closure. This will be done as part of advertising an extraordinary Council meeting. Council is also required to give public notice of its decision. This notice will be given after Council's extraordinary Council meeting.
12 The NZTA and the New Zealand Police have been consulted as required, and neither have any objection to the proposed temporary road closure.
13 The road cannot be closed for more than an aggregate of 31 days in any one year. The Transport Team has advised that there have been few road closures around the Film-Making Area and, accordingly, the 31-day limit will not be exceeded through the approval of the proposed temporary road closure.
14 Council will need to be satisfied that the temporary road closure would be unlikely to impede traffic unreasonably. Given the limited duration of the temporary road closure, traffic is unlikely to be unreasonably affected.
OPTIONS
Option One – Recommended Option
15 That the Council closes the portions of Vogel Street as detailed below;
a) Friday 19 March from 3.45pm to 2.30am the following day, from 22 Vogel St to Jetty St.
b) Saturday 20 March, from 3.45pm to 2.30am the following day, from 22 Vogel St to 115 Vogel St.
c) Sunday 21 March, from 3.45pm to 2.30am the following day, from 22 Vogel St to 115 Vogel St.
d) Tuesday 23 March, from 4pm to 2.45am the following day, from 22 Vogel St to Jetty St.
e) Wednesday 24 March, from 7:30pm to 6.15am the following day, from Queens Garden to Jetty St.
Advantages
· The road will be able to be closed and the film making will be able to proceed.
· This will enable the benefits associated with film-making in Dunedin.
Disadvantages
· There will be temporary loss of access through the closed area. However, there are detours available nearby, and safety can be assured through the use of temporary traffic management.
Option Two – Status Quo
16 That the Council decides not to close the portion of Vogel Street in question for the purpose of film making.
Advantages
· There would be no detour required for travelling public, and the road would be able to be used as normal.
Disadvantages
· The closure of the road for film-making would not be allowed.
· The benefits of film-making would be lost.
NEXT STEPS
17 Should the resolution be made to close the road, Council staff will proceed to accept the temporary traffic management plan, notify the public, the NZTA and Police.
