EXECUTIVE SUMMARY
1 This is a report for an application for a temporary authority for the premises situated at 12 St Andrew Street, Dunedin, and known as “Great Taste”. There are no specific criteria found at section 136 of the Sale and Supply of Alcohol Act 2012 (the Act) to consider however, as the holder of a temporary authority has the same duties, obligations and liabilities as a licence holder, the criteria found in section 105 may be useful as a guide.
2 The premises changed ownership in the latter part of 2020, but this was only found out by the Inspector in May 2021. There had been no attempt by the applicant to notify the various Dunedin City Council departments or this Committee of the change. The applicant was told to cease the alcohol sales and supply until such time as they had their own authority to do so.
3 The application was sent to the Police and Licensing Inspector because this is the first temporary authority sought by the applicant for this premises.
4 The Inspector submitted an adverse report, so the Committee has decided to consider the application at a public hearing.
APPLICANT AND APPLICATION
5 A temporary authority is the mechanism available to people/businesses who take over an existing licensed premises and want to be able to continue to sell and/or supply alcohol while their application for their own alcohol licence is being processed.

6 The applicant company, Great Taste Limited, was incorporated on 12 November 2020. There is one director, Deqin Wang, and two shareholders, Deqin Wang and Junlin Li.
7 They have previously been involved with “Kwang Chow Cuisine” in Dunedin and the “Hong Kong Restaurant” in Invercargill.

8 The application was not publicly advertised, nor is there a requirement to circulate the application to the Police, Medical Officer of Health or Licensing Inspector. However, as this is the applicant’s first temporary authority application for this premises, the application was sent to the Police and Inspector for comment.
Police
9 The Police have no issues with the application. They noted that the previous owner, Shi Cheng, is the named manager who will be available for functions only.
Licensing Inspector
10 The Licensing Inspector identified the change of ownership while inquiring into a manager’s certificate application for the premises. When he spoke to the new occupier, they told him the previous owner had not advised them of the requirement to advise the Council and Licensing Committee.
11 A check revealed the director and shareholders of the applicant company had previously owned two restaurants and that when they took over the Dunedin restaurant (Kwang Chow Cuisine) in 2015 they applied for a temporary authority and gave the reason “Purchasing restaurant and wishes to continue to sell alcohol on premise.” The subsequent on-licence application for this premises was determined at a public hearing.
12 The Inspector has questioned the suitability of the applicant to hold an alcohol licence and has indicated that the on-licence application would be opposed.
CONCLUSION
13 The applicant appears to have continued normal trade at the premises from November 2020 to May 2021 without authority to sell and/or supply alcohol.
14 While their stated reason is that the previous owner did not advise them of the need to notify anyone of the change, it would appear they did have that knowledge.
15 The Committee will have the opportunity to hear all parties to determine the suitability of the applicant.
