EXECUTIVE SUMMARY
1 This is a report for an application for the renewal of an off-licence for the premises situated at 153 Stuart Street, Dunedin, and known as “Biggies Pizza & Suburbia”. The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant seeks a change to the licence to allow them to sell off-licence alcohol over the bar. Currently they can only sell alcohol as part of an order for food for delivery.
3 There was no public opposition to the renewal applicant.
4 Neither the Police nor Medical Officer of Health opposed the renewal, but the Licensing Inspector would like the matter determined at a hearing because the application is significantly different to that considered in 2020.

5 The applicant has operated an on-licence from the site from 2014. There is an ‘eatery’ that operates through the day and into the evening. Later in the night a nightclub operates in a basement area.
6 The off-licence was sought during the 2020 nationwide lockdown resulting from the Covid-19 pandemic. They originally applied to sell off-licence alcohol over the counter, and it would only be done while the Biggies Pizza part of the business was operating. The applicant was looking for another income source to help support their business.
7 During the hearing the applicant was given the opportunity to discuss ‘acceptable’ conditions with the reporting agencies. At the end of an adjournment the final conditions were put to the Committee and these were accepted by the agencies. One of the points was that the applicant reserved the right to readdress the issue of over-the-counter sales at the first renewal.
PUBLIC NOTICE
8 Public notice of the renewal application did not attract any opposition.
9 The Police and Medical Officer of Health have both indicated they have no matters in opposition to the application.
10 The Licensing Inspector believes allowing the applicant to sell off-licence alcohol over the counter is a significant change to what was originally considered in 2020 and therefore should be reconsidered by the Committee at a public hearing.
CONCLUSION
11 The off-licence was obtained to try and cover some of the lost income resulting from the Covid-19 pandemic.
12 At the hearing to consider the original application the applicant was given an opportunity to reconsider what they would accept when it became apparent that the reporting agencies were willing to accept an off-licence if some of their concerns were addressed.
13 The applicant presented ‘acceptable conditions’ which were supported by the agencies and the licence was subsequently granted.
14 The applicant now seeks to readdress the matter of over-the-counter sales.
