EXECUTIVE SUMMARY
1 This is a report for an application for the renewal of an off-licence for the premises situated at 491 Hillside Road, Dunedin, and known as “Bottle O”. The criteria found at section 131 of the Sale and Supply of Alcohol Act 2012 (the Act) apply to this application.
2 The applicant does not seek any changes to the licence. The inspector considers that the sale and supply of alcohol under these conditions are consistent with the purpose of the Act and meets the criteria at section 131.
3 Public notice of the application did not attract any opposition. Neither the Medical Officer of Health nor the Licensing Inspector oppose the grant of the renewal. However, the Police do oppose the renewal and are seeking the imposition of two conditions to the licence relating to the sale of single units and the external advertising and promotion of alcohol.
APPLICANT AND APPLICATION
4 The Applicant is a company with equal directors and shareholders, Michael Lee Sumner and Emma Kate Sumner. On 18 January 2022, Narinda Kumar Singla ceased being the sole director and he, along with Suman Lata, were removed as shareholders. Michael and Emma Sumner became the new shareholders and directors of the company. There is no record of the changes being notified to the Authority. However, the Inspector points out that the change is noted on the renewal application so it may be possible previous Council staff were advised of the change but it was not recorded.
5 The premises not only sells alcohol but also carries a wide range of general household grocery items for the nearby community.
6 This is the second renewal of the licence and no change to the conditions is sought.
PUBLIC NOTICE
7 Public notice of the application did not attract any public objection and neither the Licensing Inspector nor Medical Officer of Health oppose the renewal.
8 However, the Police have opposed the licence renewal. Their grounds for opposition relate to sections 105(1)(a), (b), (h) and (i) of the Act. They believe the sale of single units of alcohol is not aligned with the object of the Act and raises doubts as to the suitability of the Applicant.
9 The Police also state that the area within 800m radius of the premises is “one of the worst areas for calls for Police service in Dunedin City” and that the premises is “one of the main off-licence premises frequented by the surrounding vulnerable community.”
10 The Police are seeking two additional conditions to the licence:
a) No single sales of beer, cider or RTDs priced at, or less than, $6.00 per unit.
b) No alcohol advertising or promotion on the premises exterior.
11 The Police state the Applicant is agreeable to the addition of the two conditions, but they have not received written confirmation.
CONCLUSION
12 This application has not attracted any objections nor opposition from the Medical Officer of Health nor Licensing Inspector.
13 Similarly, the Police have not opposed the renewal per se, but they are seeking the imposition of two extra conditions to the licence.
14 This hearing will allow the parties to present their positions.
